These Terms and Conditions ("Terms") govern your access to and use of the Novexaro website located at https://novexaro.com and associated assessment and analytics platform services (collectively, the "Platform"), operated by Novexaro, 120 Jay St, North York, ON M6L 2M2, Canada. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
Novexaro provides structured gaming performance testing and analytics services, including reaction time assessment modules, cognitive performance evaluations, hardware benchmark analysis, and editorial content related to gaming performance. All services are provided for informational and educational purposes only.
Use of the Platform is intended for individuals aged 13 or older. Users between the ages of 13 and 18 should review these Terms with a parent or guardian before using the Platform. By using the Platform, you represent that you meet the applicable age requirement.
Novexaro provides performance measurement data, not performance improvement services. Assessment results are informational data profiles that reflect measured performance under specific testing conditions. We make no representations, warranties, or guarantees that using the Platform will improve your in-game performance, competitive rank, earnings, or any other outcome. Results vary significantly between individuals and sessions. The Platform is a measurement tool, not a coaching or training program.
Assessment results are subject to the limitations of the testing methodology described in our editorial content. Measurement accuracy may be affected by device specifications, browser configuration, network conditions, and individual variability. No single-session result should be treated as a definitive measure of ability. Novexaro does not warrant that assessment results are free from measurement error, and results should be interpreted in accordance with the contextual guidance provided in our reporting.
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:
All content on the Platform — including assessment module design, editorial articles, data visualizations, software code, and branding — is the intellectual property of Novexaro or its licensors and is protected by Canadian and international copyright law. You may not reproduce, republish, distribute, or create derivative works from Platform content without prior written permission, except for personal, non-commercial reference use.
Performance data generated through your use of assessment modules is your data, subject to the rights described in our Privacy Policy. You grant Novexaro a limited license to process and store this data for the purpose of generating your reports and, in anonymized, aggregated form, for improving our assessment methodology. We do not claim ownership of your assessment results.
The Platform may contain links to third-party websites or reference third-party services. These links are provided for informational convenience only. Novexaro is not responsible for the content, privacy practices, or reliability of third-party resources. Links do not constitute endorsement.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Novexaro does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by applicable Canadian law, Novexaro, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform or its content — including but not limited to reliance on assessment results for any decision, loss of data, or technical failures. In jurisdictions where limitation of liability for consequential damages is not permitted, liability is limited to the greatest extent allowed by law.
You agree to indemnify and hold harmless Novexaro and its affiliates, officers, and employees from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from your use of the Platform in violation of these Terms or applicable law.
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Ontario, Canada, and you hereby consent to the exclusive jurisdiction of those courts.
We reserve the right to modify these Terms at any time. Updated Terms will be posted to this page with a revised effective date. Continued use of the Platform after such changes constitutes your agreement to the updated Terms.
